Intellectual Property Policy

Vividora Photography (“we,” “us,” or “our”) is committed to protecting the intellectual property rights of both our clients and photographers. This policy outlines the rights and responsibilities of Vividora Photography, our photographers, and our clients concerning the use, ownership, and protection of intellectual property.

1. Copyright Ownership

1.1 Photographer’s Copyright: All images and videos created by photographers and videographers working with Vividora Photography remain the exclusive property of the photographer unless otherwise agreed upon in writing. 

1.2 Client’s Usage Rights: Clients purchasing services from Vividora Photography are granted a limited, non-exclusive license to use the images or videos for personal, non-commercial purposes only. This includes:

  • Displaying the images in personal spaces such as homes or offices.
  • Sharing the images on social media, provided the photographer and Vividora Photography are credited appropriately.
  • Printing the images for personal use.

2. Commercial Use

2.1 Restrictions on Commercial Use: Clients may not use the images or videos produced by Vividora Photography for commercial purposes unless explicit permission is obtained in writing. Commercial use includes, but is not limited to:

  • Use in advertisements, promotional materials, or any form of marketing.
  • Selling, licensing, or distributing the images or videos to third parties for profit.
  • Use of images or videos in publications, websites, or platforms that generate revenue or promote a business. 

2.2 Licensing for Commercial Use: If a client wishes to use images or videos for commercial purposes, they must contact Vividora Photography to discuss licensing terms. Licensing fees will be determined based on the intended use, distribution, and reach of the images.

3. Photographer’s Portfolio Use

3.1 Rights to Use Images: Photographers retain the right to use the images or videos they create for portfolio purposes, including:

  • Displaying the work on their professional websites, social media accounts, and other promotional platforms.
  • Submitting the work for industry recognition, awards, or publications. 
  • 3.2 Client Consent for Marketing: Vividora Photography and its photographers may use the client’s images for marketing and promotional purposes (e.g., website galleries, social media, advertisements) with the client’s explicit written consent. Clients will be asked to opt-in for any such use after their session.

4. Protection of Intellectual Property

4.1 No Unauthorized Reproduction: Clients, third parties, and any unauthorized individuals or entities are strictly prohibited from copying, reproducing, altering, modifying, or creating derivative works from any of Vividora Photography’s intellectual property without prior written consent. 

4.2 Use of Watermarked Images: Vividora Photography may provide clients with watermarked preview images for selection purposes. These watermarked images remain the sole property of Vividora Photography and cannot be shared, distributed, or used without express permission.

5. Infringement of Intellectual Property

5.1 Reporting Violations: If you believe that your intellectual property rights have been violated or that Vividora Photography’s work is being used without permission, please notify us immediately at hello@vividoraphotography.com with the following details:

  • Identification of the copyrighted work or intellectual property being infringed.
  • Details about where the material is being used without permission.
  • Any relevant documentation proving ownership of the intellectual property in question.

5.2 Action Against Infringement: Vividora Photography will take appropriate legal action against individuals or entities that infringe upon our intellectual property rights or the rights of our photographers. This may include seeking damages, injunctions, or other legal remedies.

6. Client-Generated Content

6.1 Client Contributions: If a client submits, uploads, or contributes any content (e.g., testimonials, feedback, images) to Vividora Photography’s platforms, the client grants Vividora Photography a non-exclusive, royalty-free, perpetual, and worldwide license to use, distribute, reproduce, and display the content in connection with Vividora’s marketing, promotional, or service-related efforts.

7. Third-Party Intellectual Property

7.1 No Use of Third-Party Content: Vividora Photography respects the intellectual property rights of third parties and does not permit the unauthorized use of third-party content in any work. If you believe that content appearing on Vividora Photography’s platforms violates third-party intellectual property rights, please contact us with detailed information for review.

8. Intellectual Property of Vividora Photography

8.1 Website and Brand Assets: All content provided on Vividora Photography’s website, social media channels, and other promotional platforms, including text, images, graphics, logos, and designs, are protected by copyright, trademark, and other applicable laws. No part of these materials may be copied, reproduced, republished, uploaded, posted, or distributed in any form or by any means without prior written permission from Vividora Photography. 

8.2 Trademarks: The Vividora Photography name, logo, and any associated brand elements are trademarks of Vividora Photography. Unauthorized use of these trademarks is strictly prohibited.

9. Modifications to the Policy

Vividora Photography reserves the right to modify or update this Intellectual Property Policy at any time. Any changes will be posted on our website, and continued use of our services will constitute acceptance of the updated terms.
